Univision NOW Privacy Policy (Updated)

This is the Privacy Policy for Univision NOW, which is provided by D2C, LLC ("Univision," "we," or "us"). This Privacy Policy also applies to, without limitation, any and all WAP and mobile versions of our website, as well as any and all extensions of our website on third-party social networking sites and user-generated content hosting sites (e.g., Facebook and Twitter), whether existing now or in the future, and applications, any as well as all components, features and downloads that are, or may be, available through Univision NOW, or that interact with Univision NOW and display this Privacy Policy (collectively, the "Service.") In some cases, you will be able to use credentials created for one Univision service to access another Univision service.

This Privacy Policy informs users of the Services ("Users") what information may be collected from and/or about Users through the Service, how such information may be used and shared, and the choices Users have regarding their information. By submitting your information through the Service, you expressly give us permission to receive, store, and use such information in accordance with this Privacy Policy.

Notice To All Users:

We use a variety of third party vendors and service providers to provide operational services and support for the Service, including collecting, storing and using User information on our behalf, as well as to approve, process and fulfill your transactions for the Service.

Notice To California Residents - Your California Privacy Rights:

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by Univision to third parties for the third parties' direct marketing purposes within the immediately preceding calendar year. Univision will provide you with a list of the categories of personal information disclosed and a list of the names and addresses of the third parties. To make such a request, please send an email to optout@univisionow.com.

1. Changes to Privacy Policy

We may change this Privacy Policy from time to time. When we do, we will inform you by posting a notice through the Service. If you are a registered member of the Service, we may notify you of the changes to this Privacy Policy via email and/or may ask you to affirmatively acknowledge and consent to such changes (e.g., by checking a box or clicking a button) at the time of your next account login on our Service. Your continued use of the Service after such changes will be subject to our Privacy Policy that is current as of the time of such continued use. We encourage you to periodically review this Privacy Policy to stay informed on how we collect, use, and disclose personal information.

2. Types of Information We Collect

2.1 Personally Identifiable Information ("PII"). This is information that can identify or is linked to a specific User. When you create an account, register for certain services, access various content or features, register for promotions, or directly contact the Service (collectively, "Identification Activities" and each, an "Identification Activity"), we may ask you to provide certain PII about yourself. It is optional for you to engage in an Identification Activity. If you elect to engage in an Identification Activity, however, we may ask you to provide us with certain PII, such as your first and last name, mailing address (including zip code), email address, telephone number, date of birth, gender, and credit and debit card numbers. Depending on the activity, some of the information we ask you to provide is identified as mandatory and some is identified as voluntary. If you do not provide the mandatory information for a particular activity that requires it, you will not be permitted to engage in that activity.

In addition, please note that if you use our Service to send information about a product or service to another person (e.g., a friend, a family member, etc.), we will also collect PII of that other person to the extent disclosed by you and may contact them via email or SMS.

2.2 Aggregate and Anonymous Information ("AAI"). This is any information that cannot identify or be linked to a specific User. For example, we may collect anonymous group data (demographics, interests and preferences, etc.) about our Users. We also collect aggregate traffic data pertaining to our Service. Moreover, we may combine "User Activity Information" (as defined in Section 2.3 below) about our Users to generate aggregate information that reflects activities, habits, preferences, interests, etc. about our Users as a group. In addition, we may take PII and make it non-personally identifiable, such as by aggregating your information with information about other individuals, or by removing personally-identifiable elements (such as names) so as to "anonymize" or "de-personalize" your information.

2.3 User Activity Information ("UAI"). This refers to information collected about User activities such as on the Service. For example, the web browser type, operating system, clickstream data, IP addresses (which are numerical numbers that are automatically assigned to users' computers and mobile devices when they are surfing the Internet), ISP or mobile carrier, referring pages, date/time stamps, location information, page requests, pages visited, content viewed, clicks and search queries made, etc. We also use cookies and similar technologies to collect UAI on our Service (see Section 8 of this Privacy Policy for more information).

We do not collect personal information about your online activities over time and across third party websites or online services. Therefore, "do not track" signals transmitted from web browsers do not apply to our sites, and we do not alter any of our data collection and use practices upon receipt of such a signal.

If and to the extent we use any UAI in a manner that identifies a specific user individually (e.g., if we link or associate such information with a user's name or address), it will be treated as PII. Otherwise, all UAI will be treated as AAI.

3. What We Do With the Information

3.1 Our Use of PII. If you provide PII to us in connection with an Identification Activity, we will use the information to process, administer, manage, and communicate with you regarding such Identification Activity. For example: (1) if you create an account to use the Service, we will use your information to set up, administer, service, and communicate with you regarding, your account; (2) if you register to enter one of our contests or sweepstakes, we will use your information to process your entry and to conduct and administer the contest or sweepstakes (including communicating with you in the event you are selected as a winner); (3) if you submit a request or inquiry to us, we will use your information to communicate with you regarding your request or inquiry; (4) if you order a product or service through the Service, we will use your information to process and fulfill your order, to communicate with you regarding the same, and to provide customer service to you; (5) if you send information about a product or service to another person (e.g., a friend, a family member, etc.), we will use that other person's PII to allow him/her to receive the information you requested we send; and (6) if you provide your email or postal address to us, we may use such address to send you notices of a transactional, administrative or relationship nature or as required by law, such as notification of a material change in this Privacy Policy and/or our Terms of Use and/or Terms of Sale, notification of an actual or suspected security breach that affects your information stored by or for us, public relations announcements, etc.

We may also use your PII for direct marketing and advertising purposes. For example, we may send you emails or direct mail regarding products and services, special offers, promotions, etc.

We may also use PII to troubleshoot, resolve disputes, accomplish administrative tasks, contact you, enforce our agreements with you, including our Terms of Use and Terms of Sale and this Privacy Policy, comply with applicable law, and cooperate with law enforcement activities.

In addition, we may share PII with others as provided in Section 4 of this Privacy Policy.

3.2 Our Use of AAI. We use AAI to troubleshoot, administer our Service, analyze trends, gather demographic information, comply with applicable law, and cooperate with law enforcement activities. We may also share AAI with others as provided in Section 4 of this Privacy Policy.

4. Sharing of Information with Others

4.1 We may share PII with our Affiliates (as defined below). We may share PII with our Affiliates so that they can market and advertise products and services directly to our Users. As used herein, "our Affiliates" means any and all of our corporate affiliates (whether existing now or in the future), including (but not limited to) Univision Communications Inc., The Univision Network Limited Partnership, Univision Television Group, Inc., Univision Interactive Media, Inc., UniMás Television Group, Inc., UniMás Network, Galavision, Inc., Univision Management Co., Univision of Puerto Rico, Inc., Univision Radio, Inc., Univision ABC News Network, LLC, Made-for-Web, LLC, El Rey Holdings LLC, Uni-Rey Services, LLC and Univision Networks & Studios, Inc., and Univision Financial Marketing, LLC.

4.2 We may share PII with Business Partners (as defined below). We may share PII with and/or receive PII from third parties with whom we and/or our Affiliates do business (collectively "Business Partners") so that we and/or our Business Partners can market and advertise products and services directly to our Users.

4.3 We may share PII with Third Party Service Providers. We use third parties to perform services and functions on our behalf in connection with the Service, such as administering contests or sweepstakes, data storage and security, data research and analysis, providing marketing assistance, providing search results and links, providing technical support and maintenance for the Service, troubleshooting, and providing customer service (collectively "Third Party Service Providers"). We may share PII with Third Party Service Providers who need to access such information in order to perform services and functions on our behalf in connection with the Service.

Generally, we require that Third Party Service Providers use our Users' PII only for the purposes of performing services and functions on our behalf in connection with the Service and that they maintain the confidentiality, security and integrity of such information and not further disclose the information to others. The Third Party Service Providers have no independent rights in your PII.

4.4 We may transfer PII in a business transfer. As with any other business, we could merge with, or be acquired, in whole or in part, by another company. If this occurs, the successor or acquiring company would acquire the information maintained by or for us, including Personally Identifiable Information. The privacy policy of the successor or acquiring company may govern further use of your information.

4.5 We may disclose PII under other circumstances. We may disclose PII if doing so is required by law or, in our good faith belief, is reasonably necessary to: (1) comply with legal process (including a court order or subpoena); (2) cooperate with law enforcement; (3) enforce this Privacy Policy and/or our Terms of Use and/or Terms of Sale; (4) respond to an emergency; or (5) protect the rights, property or safety of the Service, our Users, and/or the public.

4.6 Unrestricted disclosure of AAI. Given the anonymous, non-personally identifiable nature of AAI, there are no restrictions under this Privacy Policy on how we may use, disclose, sell, or otherwise share such information. For example, we may freely share AAI with our Affiliates and Business Partners who may use such data for their own marketing, advertising, research, or other business purposes. We may also freely share AAI with Third Party Service Providers in order for them to perform services to us.

5. Updating and Correcting Information

You can access and update your name, password, billing address, and payment method in the "My Account" section of the Service. We encourage you to promptly update your PII if it changes.

After you terminate your account, you may ask to have the information on your account deleted or removed by contacting us at support@univisionnow.com; however, because we keep track of past financial transactions, we cannot delete information associated with past financial transactions on the Service. In addition, it may be impossible for us to completely delete all of your information because we periodically backup information.

6. User Choices on Collection and Use of Information

Whether to provide PII is your choice, but you understand and acknowledge that without providing PII, you will not be able to engage in an Identification Activity on the Service.

As a condition of registration, enrollment and/or purchase on the Service, we will send you Transactional/Administrative Communications and Promotional Communications. "Transactional/Administrative Communications" relate to your activity on the Service, and include emails and/or direct mail regarding a particular User's account, requests or inquiries, and purchases of products and services, notification of a material change in this Privacy Policy and/or our Terms of Use and/or Terms of Sale, notification of an actual or suspected security breach that affects Users' PII stored by or for us. "Promotional Communications," on the other hand, are emails and/or direct mail that advertise products, services, special offers, promotions, etc. from us, our Affiliates, and/or Business Partners.

Users cannot opt-out of Transactional/Administrative Communications. However, Users do have a choice with respect to Promotional Communications. If you do not want to receive Promotional Communications from us, you may elect to opt-out of receiving Promotional Communications at any time after registering by emailing us at optout@univisionow.com or by using the opt-out means (e.g., an "unsubscribe" link) provided in a Promotional Communication that you have received via email from us. Also, you can opt out of our marketing uses of your PII as well as our sharing of your PII with our Affiliates and Business Partners for their marketing uses, by sending your request via email to us at optout@univisionow.com. When contacting us, please indicate your name, address, email address, and that you want us to stop further use and sharing of your PII for marketing purposes. We will endeavor to honor your request as quickly as practicable. Your opt out election, once processed by us, will stop, on a going-forward basis, all further marketing uses and sharing of your PII by us.

IMPORTANT NOTE:

Your opt-out will NOT stop continued marketing uses of your information by those of our Affiliates and Business Partners with whom we have already shared your information prior to your opt-out. To opt out of their further use of your information, you must contact them directly (or use the opt-out means provided by them). Also, if you participate in an event or a product/service offering that is co-sponsored by us with one or more third parties, you must contact our co-sponsor(s) directly in order to opt out of their use of your information for marketing purposes.

7. Use of Social Network Account Data

The Service may allow you sign into and associate your social network accounts including, but not limited to, Twitter, LinkedIn, Facebook, YouTube, Instagram, and Pinterest with Univision.

By using this functionality, you give Univision permission to access all of the elements of your social network profile information that you have made available to be shared and to use it in accordance with the social network's terms of use and this Privacy Policy. Please refer to the privacy settings in your social network account for information about what data is shared with us and other connected applications and to manage the data that is shared through your account, including information about your activities using our sites.

We do not retain your username or password for social networking platforms for any longer than is necessary to complete an interaction. If you would like to disconnect a social media account from the Service, refer to the settings of that social media account and its provider.

8. Security of Information

We take security seriously and take numerous precautions to protect the security of PII. You can access your PII on our Service through a user name and password (if you are a registered member of our Service). This password is encrypted. We recommend that you do not share your password with anyone. In addition, your PII resides on a secure server that only selected personnel and contractors have access to. We encrypt certain sensitive information using Secure Socket Layer (SSL) technology to protect your PII as it is transmitted to us.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we employ commercially reasonable security measures to protect data and seek to partner with companies, which do the same, we cannot guarantee the security of any information transmitted to or from the Service, and are not responsible for the actions of any third parties that may receive any such information.

By providing your email address to us on the Service, you acknowledge and agree that we may notify you by email in the event of a breach of security involving your PII stored by or for us.

9. Data Tracking

9.1 Cookies. To facilitate and customize your experience with our Service, we store cookies on your computer. A cookie is a small text file that is stored on a User's computer for record-keeping purposes which contains information about that User. We use cookies to save you time while using our Service, remind us who you are, and track and target User interests in order to provide a customized experience. Cookies also allow us to collect UAI from you, like which pages you visited and what links you clicked on. Use of this information helps us to create a more user-friendly experience for all visitors. Most browsers automatically accept cookies, but you may be able to modify your browser settings to decline cookies. Please note that if you decline or delete these cookies, some parts of our Service may not work properly.

9.2 Other Tracking Devices. We may use other industry standard technologies like pixel tags and web beacons to track your use of the Service, or we may allow our Third Party Service Providers to use these devices on our behalf. Pixel tags and web beacons are tiny graphic images placed on certain pages on our Service, or in our emails that allow us to determine whether you have performed a specific action. When you access these pages or open or click an email, pixel tags and web beacons generate a Non-Personally Identifiable notice of that action. Pixel tags allow us to measure and improve our understanding of visitor traffic and behavior on our Service, as well as give us a way to measure our promotions and performance. We may also utilize pixel tags and web beacons provided by others for the same purposes.

9.3 Third Party Ad Servers. Third-Party Ad Servers and Advertisers, including so-called "network advertisers" or "ad networks", may place or serve or manage ads on our Service. In addition, they may provide us with data collection, reporting, ad response measurement, site analytics, and assist with delivery of relevant marketing messages and advertisements. In some cases, we may associate this information with the information we have collected about you as described in Section 2 of this Policy, "Types of Information We Collect." In addition, market research companies, such as Nielsen TV Ratings may collect information about you, including video content that you have watched through the Service. By watching video content through the Service, you consent to allow us to share information about you with these market research companies. 9.4 Third Party Functionalities. Our Service contains links to and/or enables certain third-party functionalities to enhance your experience on our Service, including social plug-ins, tools and APIs. Prior to using any third-party functionalities (e.g., Facebook "Like" button) on our Service, you should consult the privacy notices of the third-party providers of such functionalities (e.g., Facebook), as we have no control over information that is submitted to, or collected by, such third parties, or how they may use the information. The privacy policies and data practices of such third parties may significantly differ from ours, and we make no representation or warranty whatsoever about their policies and practices. Your communications and interactions with such third parties are solely between you and them, and are at your own risk.

9.5 Flash Cookies. From time to time, we may use Flash cookies or similar technology for tracking purposes, saving preferences or when serving and managing ads on our Service. 10. Privacy Policies of Third Party Websites

The Service may provide links to third-party websites (such as websites of our Business Partners). Also, our Service may contain and/or display third-party ads (such as ads of our Business Partners), and clicking or replying on such ads will take you to third-party websites. We have no control whatsoever over such third parties, their websites, or their products or services. Once you leave our Service and go to a third-party site or initiate communication with a third-party, this Privacy Policy will no longer apply, and any information collected from or about you on that third-party site will be governed by the privacy policy of that third party. Third-party sites do not follow our Privacy Policy and their privacy policies may be substantially different from this Privacy Policy. Such third-party sites may send their own cookies to you and may collect data from and/or about you and make use of that data in ways that our Service would not. You access such third-party sites, services or products entirely at your own risk. You should always read the privacy policy for a third-party site, service or product before disclosing any personal information on such site or in exchange for such product or service.

11. Miscellaneous

11.1 Children. Children's safety is important to us, and we encourage parents and guardians to take an active interest in the online activities of their children. Our Service is not directed to children, and we do not knowingly collect personal information from children under the age of 13. If you are a parent or guardian of a child under the age of 13, and you become aware that the child has provided us with personal information without your consent, please contact us at support@univisionnow.com.

11.2 Consent to Processing in the United States. By providing any PII to us, all Users, including Users in Canada and the member states of the European Union, fully understand and unambiguously consent to this Privacy Policy and to the transfer of such PII across international borders in accordance with our standard operations, including the collection, storage, and processing of such information in the United States of America.
